TN Sports Betting Legislation

Sports betting was legalized in Tennessee after HB 0001 was passed in May 2019. However, the first online sportsbook started operations in November 2020.

The legislation made the Tennessee Education Lottery Corporation responsible for regulating the sports betting scene and issuing licenses to operators. Per the law, sportsbooks could apply for licenses from this regulatory body to offer their services in Tennessee.

However, this changed in 2021. Legislators made a new vote appointing the Tennessee Sports Wagering Advisory Council (SWAC) as the new regulatory body for sports betting. This change may have been influenced by the credit card fraud allegations levied against Action 24/7, leading to the temporary suspension of its license.

On January 1, 2020, the Tennessee Sports Wagering Advisory Council took over as the new regulatory body responsible for issuing licenses. In 2023, SB 0475 was approved and renamed the Sports Wagering Council. The new legislation also eradicated the 10% hold rule and changed the tax to 1.85% on the handle, as opposed to a 20% tax on revenue.

In addition, the law also came with some key details, such as:

1. Bettors will need to be at least 21 years old and physically located in Tennessee to place wagers
2. Licensed operators could accept online wagers through mobile betting applications
3. Licensed online sportsbook operators were not allowed to accept prop bets on individual college athletes
4. Operators were required to pay an upfront licensing fee of $750,000 and a $75,000 renewal fee

Timeline of Tennessee sports betting history

Here's a timeline of the key moments that led to the legalization of sports betting in the Volunteer State.

• January 2019: Representative Rick Staples filed a House Bill to legalize sports betting in the state. There was also a similar Senate Bill introduced.
• May 2019: Gov. Lee did not sign the bill and returned it to the legislature after a month. However, the bill went into law regardless.
• November 2019: Lawmakers set up a 10-member panel, and they created an initial draft for regulations
• January 2020: The initial draft produced more than 300 comments in criticism during the 45-day comment period. This left the board with a month to revise the draft.
• February 2020: Various meetings were held to deal with the issues raised in the draft. A meeting date was set for the advisory board to vote and discuss the updated draft of regulations.
• March 2020: As the pandemic started to go into full effect, the TN Lottery Board and Advisory Council met and made progress on the proposed sports betting regulation. During this period, lawmakers proposed rules aimed at giving the Advisory Council more control in the industry.
• April 2020: The approved sports betting regulations were released by the Tennessee Lottery Board. It came with a 10% hold manade, which was more than the 5% recommended by the Advisory Council. The lottery also released the requirements for operators looking to apply for a license a few days later.
• June 2020: Three operators partially completed the paperwork and paid the $750,000 licensing fee. The last operator was denied an extension.
• August 2020: The TN lottery announced that they were currently vetting applications from four operators, with plans to get them up and running by November 1.
• September 2020: The Tennessee Lottery announced that BetMGM, DraftKings, and FanDuel have been conditionally approved to begin operations on November 1.
• October 2020: The Tennessee Lottery announced that Action 24/7, based in Nashville, has received a conditional license. It also mentioned that it received applications from other operators, but did not mention any names.
• November 2020: Sports betting went live on Sunday, November 1, 2020, with BetMGM, DraftKings, FanDuel, and Action 24/7 launching with different promotional offers. BetAmerica, WynnBet, and William Hill are identified as the next operators being vetted to join the market
• March 2021: William Hill becomes the fifth online sportsbook to launch in the state. Twinspires also made its debut a week later.
• April 2021: Wynnbet goes live on April 30, making it the seventh TN app to launch
• June 2021: The first meeting is held by the Sports Wagering Advisory Council to transfer regulatory authority from the Tennessee Lottery
• August 2021: Caesars goes live in Tennessee after the acquisition of William Hill
• September 2021: Wagr and Barstool Sportsbook received sports betting licenses from the Tennessee Education Lottery and went live on September 8.
• January 2022: The Sports Wagering Advisory Council becomes the new regulatory body for Tennessee sports betting. It also releases some temporary rules pending the creation of permanent regulations.
• February 2022: Fubo Gaming received a license to launch on February 11, 2022
• April 2020: Superbook Sports goes live in Tennessee. However, Twinspires Sportsbook chose not to renew its license, which was due this month.

Other TN Betting Options

The betting scene in Tennessee is very regulated and as such, there are few options aside from legal sportsbooks. Online casinos and poker sites are not legal at the moment, but there are other alternatives which we will cover below.

The Tennessee Lottery

The Tennessee Lottery was created on June 11, 2003, and is overseen by the Tennessee Education Lottery Corporation (TELC). It  generates billions for the state, which goes to the education program.
