In 2021, Governor Ciomo signed the state's 2022 fiscal budget, which included a bid to legalize mobile sports betting. Upon signing, online sports betting was officially authorized in the state.
The New York sports betting law also consisted of a few key points, including:
- The New York Gaming Commission was authorized to receive bids from interested mobile sports betting platforms and choose two providers.
- Each provider will operate two different sportsbook apps
- At least 50% of the revenue from each platform is to go to the state
- The Empire State may approve additional platforms and skins if it is in its best interests.
- Ultimately, New York has one of the strictest laws for online sports betting applicants, but this did not stop operators from tapping into the market.
Timeline of New York sports betting history
Many key moments led to the legalization of sports betting in New York, and we’ll take you through them below.
- November 2013: Voters approve a referendum calling for the expansion of online gaming. This led to the creation of four casinos in specified upstate casinos. Included in this law was a provision for these casinos to allow sports betting if the federal ban is revoked. However, there was no mention of online sports betting in this bill.
- May 2018: The Supreme Court rules PASPA unconstitutional. NY lawmakers quickly start to create sports betting regulations for the state.
- January 2019: The New York Gaming Commission releases NY sports betting rules as authorized by the 2013 online gaming expansion laws.
- July 2019: Rivers Sportsbook in Schenectady, New York's first upstate casino, launches. It was the first place New Yorkers could legally wager on sports events. The first bets were placed by Gary Pretlow and Schenectady Mayor Gary McCarthy.
- January 2020: The General Assembly receives a new regulation that aims to make online sports betting legal. This leads to the creation of a task force to show the likely fiscal impact if online sports betting becomes a reality.
- April 2021: A $212 billion deal legalizing mobile sports betting is approved by NY lawmakers. This deal also included a plan for online sports betting.
- January 2022: It was reported that a total of nine sportsbooks will receive online betting licenses in New York. The state went on to announce that these would be the sportsbooks to launch in its online betting market when it goes live.
- January 2022: The state reports that online sports betting will kick off on January 8, 2022, and that four sportsbooks met the requirements. These included FanDuel, DraftKings, Caesars, and BetRivers. By January 17, 2022, BetMGM also joined the list of providers in the NY sports betting market.
- March 2022: A New York assemblyman introduced an amendment to the bill. It proposed to increase the approved number of sportsbooks from 9 to at least 14 by 2026, and no less than 16 by 2027. The goal was to help bring down the high 51% tax rate imposed on sportsbooks to 25% to enable competition.
- May 2022: Gov. Kathy Hochul announces that the state has accumulated $267 million from sports betting since January 2022, with online sports betting generating $263 million.
- July 2022: Bally Bet gets a New York license, making it the last of the nine initial proposed sportsbooks to start operations in the state
- November 2022: It was reported that DraftKings and FanDuel were responsible for 67% of the New York sports betting handle and 72% of its total gaming revenue.
